Terms of Service
1. Service Description
TrialScreen provides an AI-powered clinical trial pre-screening platform that conducts voice and SMS conversations with potential study participants, scores eligibility against protocol criteria, and exports structured data to clinical trial management systems. The platform is designed for use by clinical research organizations, research sites, and sponsors.
2. Permitted Use
You may use TrialScreen solely for lawful clinical trial pre-screening purposes. You are responsible for ensuring that your use of the platform complies with all applicable regulations, including HIPAA, TCPA, 21 CFR Part 11, and any applicable IRB/ethics committee requirements. TrialScreen is a pre-screening tool and does not replace clinical judgment or formal eligibility determination by qualified investigators.
3. Data Ownership
You retain ownership of all data you upload to or generate through TrialScreen, including protocol documents, participant data, screening results, and analytics. TrialScreen does not claim ownership of your data and will not access it except as necessary to provide the service or as required by law.
4. Service Availability
We target 99.9% uptime for Enterprise plans and 99.5% for Site and CRO plans, excluding scheduled maintenance. Scheduled maintenance windows will be communicated at least 48 hours in advance. We are not liable for service interruptions caused by third-party infrastructure providers.
5. Billing
Subscription fees are billed monthly or annually as selected. Overage screens are billed at the per-screen rate specified in your plan. All fees are non-refundable except as required by law. We will provide at least 30 days notice of pricing changes.
6. Termination
Either party may terminate the agreement with 30 days written notice. Upon termination, you may export your data within 30 days. After that period, data will be deleted per our retention policy. Termination does not release either party from obligations incurred prior to termination.
